COMPLAINTS
JULY 2001
- The
Association receives a number of complaints in writing and
over the phone during any given period. Each of these
complaints must be validated and, by in large they prove to be
legitimate. In each instance the Association does what it can
to resolve the legitimate complaints as quickly as possible.
However, there are times when the target of the anonymous
complaint is not within the jurisdiction of the Association or
the staff is already working on the problem, but because of
its complexity, the matter requires an inordinate amount of
time to reach resolution. In any case, MTA personnel have no
way to inform the anonymous complainant that the matter is not
within the Association's jurisdiction or that the matter is
being worked on to the best of our ability. Thus, in the eyes
of the complainant, the Association is not
doing anything to alleviate the situationMTA
requests, if you are writing to us to express a concern in the
community or phoning to complain about a situation in your
neighborhood, that you let us know your name and address
and/or phone number. This information is held in the strictest
of confidence. The Association does not divulge the name or address of a complainant to anyone. However, in many cases,
the Association needs to contact the complainant to either
inform he/she of progress on the matter or to obtain
additional information needed to hopefully resolve the
situation. Unless you inform us of your identity, we are
unable to advise you regarding any progress with your
complaint.
MILILANI
ALL STAR BASEBALL TEAM WINS STATE TOURNAMENT
AUGUST 2001 - The Mililani All Stars recently participated in
the State KAC Tournament, which took place over a two-week
period. Various all-star teams played elimination rounds over
the duration of the tournament. The Mililani team successfully
defended its title to be seeded number one and on July 1,
2001, in the final game of the tournament, defeated the
Waipahu All Stars eight runs to six to bring home the
championship trophy.
The
Mililani All Star team is composed of members selected from
the various Mililani Pony League teams for their athletic
ability in playing the game of baseball.
CONGRATULATIONS to all the team
members and the coaches for an outstanding job!
U.S.
GOVERNMENT CLEAN UP OF FUEL STORAGE TANKS CONTINUES
AUGUST 2001 - MTA has been informed by government services
that the Corp of Engineers will once more be working in Kipapa
Gulch and in the area between Mililani Town and Wheeler Army
Base cleaning up several of the fuel storage tanks left in the
area since World War II.
The clean up operation is currently
scheduled to commence in September 2001 and should be
completed within the month.
PET
PEEVE
AUGUST 2001 - Once again, the Association is receiving
numerous calls from angry residents complaining about what
they consider to be inconsiderate pet owners. The complainants
single out those pet owners who allow their animals to do
their “business” just anywhere and fail to clean up after
them. Usually the caller has just received a visit from one of
the errant animals, which has left a ”calling card” on
their front lawn. Other callers are particularly incensed that
the animal being walked by its owner is allowed to relieve
itself and the pet owner simply walks away without cleaning up
the mess.
Pet
owners should be more considerate of their neighbors. If you
are not doing so, please clean up after your animal. Dog
owners should be aware that there is now a City & County
Ordinance regarding the discarding of dog waste. Article 4
“Litter Control of the Revised Ordinances of Honolulu,
Section 29-4.4 Prohibited Activities” states, in part, that
no person shall permit an animal in his/her custody to excrete
solid waste in a public place or on private premises not that
of the animal owner. Section 29-4.8 Violation Penalty goes on
to state that persons found guilty of violating this article
will be ordered to reimburse the city for the cost to remove
the litter and could be subject to a criminal fine not to
exceed $500 per offense.
In addition to being a violation of a
City & County Ordinance, allowing your pet to use someone
else’s property or the sidewalk as a bathroom is not very
neighborly. We all live in the same community and should try
to keep it as neat and as pleasant a place in which to live as
possible.

ASSESSMENT
REMINDER
JULY 2001 - Mililani homeowners are reminded that the second
quarter assessment payment of $63.00 is due on July 1, 2001.
Section 6.02(d) of the Mililani Town Declaration of Covenants,
Conditions & Restrictions requires that assessments be
paid on or before the first day of each April, July, October
and January. Homeowners with questions regarding their account
or related assessment matters may call the MTA Accounting
Department at 623-7300, Monday through Friday during normal
business hours from 8:00 a.m. to 4:30 p.m.
MILILANI
TROLLEY STILL RUNNING
JULY 2001 - The Association has been notified by Castle &
Cooke Homes Hawaii that the Mililani Trolley will continue to
serve the community at least until the end of October 2001.
The future of the trolley after that date is uncertain. A
problem with the trolley service arose at the end of May when
Transhawaiian Services abruptly discontinued its entire bus
service, including the trolley. However, with only a brief
interruption in service, E Noa Corp. has been retained to
continue the Mililani Trolley. The schedule and stops will
remain the same as the old service. However, the flex and
monthly pass program has been discontinued. Riders must pay
the posted fares upon entering the trolley.
MTA
APPROVES FLOTATION DEVICE POLICY FOR SWIMMING POOLS
AUGUST 2001 - At its June 20, 2001 meeting the MTA Board of
Directors adopted Administrative Resolution No. 61
establishing procedures by which homeowners may receive a
letter of waiver for the use of specified flotation devices in
an MTA swimming pool for special conditions of the homeowner.
Homeowners who, while using a
swimming pool facility, require the use of a flotation device
as prescribed by a physician for either a temporary or
permanent physical disability must have the applicable
“Doctor’s Confidential Certification Form” completed by
their physician. There are two types of this form (Exhibit A
or B) available depending on the homeowner’s degree of
physical disability. Exhibit A is “For Handicapped Patients
Requiring The Use Of Flotation Devices In Swimming Pools”
and Exhibit B is “For Individuals With Temporary Physical
Limitations Requiring The Use Of Flotation Devices In Swimming
Pools.”
The Request Form, outlining the
instructions on how to submit the request, and Exhibits A and
B are available at any Recreation Center and also at the
Administrative Office. Simply ask the Building Attendant at
the Recreation Center or Member Service Coordinator at the MTA
Office for the instructions and Exhibit Forms.Based
on the physician’s determination as to which Exhibit is
applicable, MTA will issue a “Letter of Waiver” permitting
the special use of the specified flotation device being
recommended by a the physician. Both the Request Form and the
applicable Exhibit (either A or B) must be completed and
returned to the MTA Recreation Manager for a “Letter of
Waiver” to be issued.
VEHICULAR
RECONSTRUCTION & REPAIR IN MILILANI
AUGUST 2001 - The Association has recently received a number
of complaints from Mililani Town residents who are
justifiably angry with a neighbor or someone living nearby
who has set up a vehicle repair shop in their carport. The
noise of drills, sanders and grinders disturbs the ordinary
peace and quiet of the neighborhood, not to mention the
hazards associated with acetylene torches and tanks.
Both
homeowners and residents living in the community should be
aware that there is a provision in the M.T.A. Declaration of
Covenants, Conditions and Restrictions that addresses and
prohibits this type of activity in Mililani Town. Article
III, Section 302(k) of the DCCR’s states that “No
trailer or boat shall be constructed, reconstructed or
repaired upon any lot in such a manner that such
construction, reconstruction or repair is visible from
neighboring properties, nor shall any vehicle not in good
operating condition be maintained on any lot so as to be
visible from any adjoining streets.” In addition, the
provision states: “Without limitation to any other remedy
set forth in this Declaration, the Association, by its
agents, shall have the right to enter upon any lot where any
automobile is being repaired or is being maintained which is
not in good operating condition, and to remove such
automobile to a public dump, a repair shop or a storage yard
and the Owner of the lot shall be responsible for all costs
involved (whether or not he be the owner of the automobile)
and shall pay to the Association all costs incurred, and the
Association and its agents shall not be liable for trespass
or for conversion or for any damages to such automobile or
for the taking of same.”
In essence, this provision of the DCCR’s states that, if a
homeowner is in the process of restoring,
reconstructing, or doing major repairs to any vehicle that
can be seen from the street or neighboring property, it is a
violation of M.T.A. governing documents. Also, owners with a derelict or
inoperative vehicle located on their property, which can be
seen from the street or neighboring property, will be
required by the Association to remove the vehicle from that
property within ten (10) days. In both cases, if the
homeowner fails to cease repairs or reconstruction work, or
remove any vehicle from the property that is not in good
operating condition, within the specified time, said
homeowner runs the risk of having the Association act to
have the automobile removed at the owner’s expense.
One of the Mililani Town
Association’s primary functions is to protect property
values within the community. It is for this reason, among
others, that homeowners have bought property in Mililani
Town, along with the expectation that the peace and quiet of
the neighborhood will be maintained.
If
you are one of those homeowners who is experiencing such a
problem, call the Mililani Town Association Office at
623-7300 and make a formal complaint. Your confidentiality
will be respected. The Association will then take
appropriate steps to attempt to verify the complaint and
compel those homeowners who are violating this important
provision in the M.T.A. DCCR’s to cease their activities.
