Dear Mr. O`Neill:
Please find accompanying this letter various exhibits which Mr. Marsh expects to introduce at the upcoming hearing on the motion to dismiss. Per your telephone discussion with Mr. Pingree and the Tax Court Judge regarding the exhibits to be introduced, request is hereby made that you review these documents and stipulate to the foundations of each. After receiving your response, we will prepare a formal stipulation to those matters we are able to reach agreement.
Mr. Pingree is out of town presently and will be returning soon, at which time I will have him continue with this matter of a stipulation. Meanwhile, please contact me at the above address should you have any questions or wish to discuss these matters. Please take the utmost care in reviewing these documents. These are the only set of documents we have. Feel free to copy them, should you wish to, but do not tear, mutilate or in any way deface or destroy them. Your taking appropriate precautions will be greatly appreciated.
